Limitation to Commercial and Industrial Uses. The Property is hereby restricted to ?commercial land uses? and ?industrial land uses?, as defined in OAC Rule 3745-300-08(C)(2)(c)(ii) and 08(C)(2)(c)(iii) (effective March 1, 2009). "Commercial land use" means "land use with potential exposure of adult workers during a business day and potential exposure of adults and children who are customers, patrons or visitors to commercial facilities during the business day. Commercial land use has potential exposure of adults to dermal contact with soil, inhalation of vapors and particles from soil and ingestion of soil. Examples of commercial land uses include, but are not limited to warehouses; retail gasoline stations; retail establishments; professional offices; hospitals and clinics; religious institutions; hotels; motels; and parking facilities." OAC Rule 3745-300-08(C)(2)(c)(ii) (effective March 1, 2009). "Industrial land use" means "land use with potential exposure of adult workers during a business day and potential exposure of adults and children who are visitors to industrial facilities during the business day. Industrial land use has potential exposure of adults to dermal contact with soil, inhalation of vapors and particles from soil and ingestion of soil. Examples of industrial land uses include, but are not limited to: lumberyards; power plants; manufacturing facilities such as metal-working shops, plating shops, blast furnaces, coke plants, oil refineries, brick factories, chemical plants and plastic plants; assembly plants; non-public airport areas; limited access highways; railroad switching yards; and marine port facilities." OAC Rule 3745-300-08(C)(2)(c)(iii) (effective March 1, 2009). Limitation Prohibiting Ground Water Extraction and Use. Groundwater underlying the Property shall not be extracted or used for any purpose, potable or otherwise, except for investigation, monitoring, or remediation of the groundwater or for extraction in conjunction with construction or excavation activities or maintenance of subsurface utilities such as to dewater a trench.

Additional Property Attributes

Building demolition and building cleanup activities have been completed under a Clean Ohio Revitalization Fund grant. Former Use: The Building 116 property is a 5.95 acre property that is currently undeveloped and located at 1381 Techway Street. It was formerly occupied by a 5-story, 121,604 square foot building that was part of the Goodyear Plant #3 campus. It was constructed in 1929 and was historically used for storage and warehousing of finished products until the early 1980s. Processes were also conducted in the building including curing of dock fenders, assembly of rubber hoses, air bladders and springs, miscellaneous assembly work, and production of self sealing fuel tanks. The property has been vacant since the 1980s. The property was owned and occupied by Goodyear for over 80 years. The building was cleaned up and demolished under a Clean Ohio Revitalization Fund grant in 2010. The Phase II assessment activities funded under this grant included the installation and sampling of new and existing monitoring wells to support the development of the No Futher Action (NFA) letter.
