The Kansas Department of Health and Environment (KDHE) conducted a Phase I Brownfields Targeted Assessment (BTA) on approximately 38 acres of undeveloped vacant riverfront property located near the southeast corner of Highways 69 and 7 east of Marmaton River and west of the City�s Water Treatment Plant in Fort Scott, Kansas. The BTA was conducted for the Fort Scott/Bourbon County Riverfront Authority through the KDHE Coalition Assessment Grant # BF 97741501 � hazardous substance funding. The BTA Site has an unknown environmental status and will be donated to the Riverfront Authority by the current landowner for the Riverfront Park redevelopment project. A Phase I environmental site assessment was necessary to fulfill the due diligence requirements prior to the transfer of ownership. Based on the Phase I report, �Recognized Environmental Conditions� (RECs) were identified as potential hazardous substance impacts associated with potential releases from an adjacent upgradient RCRA Small Quantity Generator facility, Tower Metal Products. Due to the potential for subsurface impacts on the BTA property, a Phase II was completed in April and May, 2014. The Phase II consisted of one Test Pit and one collocated soil/groundwater boring. 1 soil sample and 1 groundwater sample were analyzed for Resource Conservation and Recovery Act (RCRA) metals and polycyclic aromatic hydrocarbons (PAHs), volatile organic compounds (VOCs), total petroleum hydrocarbons (TPH) diesel range organics (DRO), and TPH gasoline range organics (GRO). Based on the results of the laboratory data, arsenic was detected in the groundwater boring above KDHE Risk-Based Standards for Kansas (RSK) residential level. No other contaminants were detected in the groundwater above the KDHE RSK. A Groundwater Potability Assessment was completed for properties located along the Riverfront as part of the Phase II assessment activities. Based on the findings presented in the June 2014 report, the estimated yield for the shallow groundwater aquifer is 3.4 to 5.8 gallons per day (gpd). In accordance with KDHE BER Policy BER-RS-045 Considerations for Groundwater Use and Applying RSK Standards to Contaminated Groundwater, the first groundwater aquifer located in the vicinity of the riverfront is low yielding (i.e., less than 150 gpd), and is not considered to be a potable aquifer. Several RCRA metals and PAH constituents were detected in the soil sample collected on the property, but all reported concentrations were below the KDHE RSK residential levels. Based on results of the Phase II investigation and the low yield groundwater conditions in this area, further action under the Brownfields Program is not warranted, and the Riverfront BTA #6 property is cleared for redevelopment.

Former Use: The site consists of three parcels of vacant riverfront greenspace that has been vacant since at least 1893. Between 1958 and 1978, the Marmaton River, was naturally relocated to flow on the west adjoining property rather than through the BTA property. David and Linda Dotson are the current owners and obtained the property from James and Delores Dotson in 1981. Prior to this, the owners were other various private individuals.
