Additional Property Attributes

The direct contact pathway can be eliminated via source removal, remediation, or an engineering control to prevent contact with the impacted soils. An engineering control such as fencing or capping (i.e. a paved parking lot, buildings, sidewalks, placement and maintenance of new topsoil and sod, etc.) the impacted areas would eliminate the direct contact pathway. In the event soil is not excavated or remediated, an environmental restrictive covenant (ERC) should be prepared and recorded with the deed to protect visitors to the Property and future receptors. The ERC would restrict the disturbance of the impacted areas, even where an engineering control eliminates the direct contact pathway. If the impact is removed via excavation or remediation, no ERC needs to be prepared for the direct contact pathway. If only the soil exceeding the commercial/industrial direct contact screening levels is removed or capped, an ERC should limit the Property use to only commercial/industrial purposes. A Comfort/Site Status Letter request - State Form 51493 should be submitted to the Indiana Finance Authority (IFA) Brownfields Program along with copies of this report and the most recent Phase I completed.
