Institutional and Engineering Controls

A Comfort/Site Status Letter request should be submitted to the Indiana Finance Authority (IFA) / Indiana Brownfields Program (IBP) along with copies of this report, the Phase I ESA completed in October 2014, and an updated Phase I ESA. Subsequent to the acceptance of the Property into the IBP, the IBP/IDEM may issue a Comfort Letter that outlines the applicable liability exemption and/or IDEM�s exercise of enforcement discretion under an applicable IDEM Non-Rule Policy. It may be necessary to record an Environmental Restrictive Covenant (ERC) that will be used as an institutional control protecting visitors to the Property.
