Due Care Obligations Include;

Concentrations of VOCs were detected in the soil gas samples at concentrations greater than 10 times below the applicable Nonresidential VISLs. Therefore, the purchaser of the subject property will complete one additional soil gas sampling event in June 2015 to document seasonal variation in contaminate concentrations to determine if higher concentrations exists that could warrant additional measures to mitigate vapor exposure.

Any subsurface construction will be planned and implemented in a manner as to not increase offsite migration along subsurface utility, sewer, or structure corridors.

The owner of the property may have obligations under TSCA. However, based on the location of the PCBs which are capped by the concrete floor and building foundation, and the Nonresidential use of the property, there is no current exposure pathway.

The purchaser of the subject property will also monitor the surface cover (i.e. concrete building floor and foundation) and maintain the structural integrity of the surface cover to prevent exposure to PCB impacted soils.

Additional Property Attributes

Plans include several updates to existing structure including new roof, new interior along with technology updates. Through these updates new owner will hire additional employees without sacrificing existing employee structure at subject property. UPDATE: Property transaction fell through. No redevelopment planned at this point.

Former Use: Original development included two residences and a commercial building, all of which were demolished by 1929. Former commercial occupants included a grocery store from at least 1919 until 1924. The occupants associated with the original commercial building from initial construction prior to 1888 until 1919 could not be determined through review of historical sources; however, based on the layout of the building and the known past uses, the tenants were likely commercial in nature and included similar retail operations. The property was redeveloped between 1924 and 1929 with a commercial building in the central portion of the property, which was demolished by 1967. Former occupants included a gasoline service station from at least 1929 until 1959 and an automotive transmission repair shop from 1961 until 1967. The current building was constructed in the central portion of the property in 1967, and has been occupied by an automotive transmission repair shop since that time.
