Additional Property Attributes

Future plans consist of redeveloping the subject property with multi-residential housing and retail businesses. Based on the potential use of hazardous substances associated with various historic operations identified at the subject property, previous investigations have been conducted throughout the north and west portions of the site. Specifically, a Phase I ESA, a Phase II ESA and a Baseline Environmental Assessment (BEA) were completed for 241, 255 and 285 W. Western Ave. by Prein & Newhof in 2007-2008. In addition, a Phase I ESA, a Phase II ESA and a BEA were conducted for 880 1st St. by Attwell Hicks, LLC in 2008. We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-13 for the Highpoint Flats property located at 241, 255, and 285 W. Western Ave., 208 and 216 W. Clay St., and 880 1st St., Muskegon, Michigan, the property. Any exceptions to, or deletions from, this practice are described in the Limitations section of this report. This assessment has revealed no evidence of Recognized Environmental Conditions (RECs) in connection with the property except for the following: � The presence of silver and various polynuclear aromatic hydrocarbons (PNAs) in the soil, and manganese and mercury in groundwater identified during the 2007/2008 environmental investigations that exceed current residential cleanup criteria. The existing data demonstrates that four of the six parcels that comprise the subject site have been identified a �facility� as defined by Part 201 of the Natural Resources and Environmental Protection Act (NREPA). These contaminants appear to be consistent with urban fill found throughout downtown Muskegon, and it is presumed that similar conditions would be found in soil at the other two parcels. � Soils at the subject property are urbanized, and fill is likely to have been used in the past. Spent foundry sand was historically used as fill and numerous environmental investigations at nearby properties have confirmed the presence of contaminants in this material. The likelihood that fill material exists beneath the subject site, similar to surrounding properties, is considered an REC. The analytical results indicate that portions of the subject property (241, 255 and 285 W. Western Ave. and 880 1st St.) meet the definition of a �facility.� In addition, the common use and history indicates the likelihood that all portions of the subject property (including 208 and 216 Clay Ave.) would have similar conditions of impact in the site soils as referenced in the above RECs. Thus, Envirologic prepared a BEA and Documentation of Due Care Compliance for the City of Muskegon and Parkland Muskegon, Inc. in order to obtain an exemption to remedial liability for pre-existing contaminant conditions and demonstrate compliance with �due care� obligations. Envirologic recommends that the unmarked containers observed in the basement of the former bank building located at 880 1st St. be characterized and removed from the site for proper disposal.

Former Use: The subject property consists of six contiguous parcels of land that comprise an entire city block located in the downtown commercial district of the City of Muskegon. The subject property is developed with three structures that are currently unoccupied, while the remaining portions consist of vacant grass-covered land and asphalt-paved areas. The site buildings were most recently used as banks and office spaces. Historically, the subject property development has consisted of numerous dwellings, assorted commercial businesses, small storefronts, and a few small industrial operations from at least 1883 until 1973. Former industrial operations included a printing company, machine shop, body shop/garage, a taxicab company, and a laundry. Since the mid-1970s portions have been either vacant or used for commercial/ administrative purposes.
