? Prohibited use or extraction of groundwater across the Property for human or animal consumption. No wells can be installed for any purpose other than contaminant assessment or monitoring without IDEM approval.

? No use permitted for Affected Area 1 or Affected Area 2 (high lead concentrations in soil) for single-family or duplex residential use without first removing soil contaminated at levels above IDEM RCG Residential Direct Contact Screening Levels (RDCSLs) to a maximum depth of 10 feet below ground surface.

? No use permitted for agricultural purposes and all ornamental plantings must be placed in raised beds filled with a minimum depth of at least 18 inches of ?clean? soil (demonstrated not to contain contaminants of concern above IDEM RCG RDCSLs).

? In any multi-tenant residential and/or mixed use development scenario (including housing, daily child care facilities, or education facilities), a two-foot barrier of ?clean? soil must be installed in areas that, as part of redevelopment, are not covered by a building, surface parking lot, sidewalk, or capped with soil, and maintain their integrity. Buildings, parking lots, sidewalks and/or soil-capped areas will serve as engineered barriers to prevent direct contact with the underlying soils and must not be excavated, removed, disturbed, demolished, or allowed to fall into disrepair without replacement by a barrier that will provide equal or better protection.

? Neither engage in nor allow excavation of any soil barrier or soil under raised beds installed on the Property without first submitting a work plan to IDEM at least 60 days prior to beginning work for approval by IDEM within 30 days of receipt. Any removal, excavation or disturbance of soil from the Property must be conducted in accordance with all applicable requirements of IOSHA/OSHA, and any soil that is removed, excavated or disturbed from the Property must be managed and disposed of in accordance with all applicable federal and state laws and regulations.

Additional Property Attributes

This property is associated with CA#BF-00E01157-0 Acres Property Numbers: 165543 and 172962. At the time of the reconnaissance, the Property consisted of approximately 1.82 acres of land developed with four commercial/industrial buildings. The buildings included a vacant three-story brick building that totaled approximately 63,000 square feet (NISCO: 304-326 South Main Street); an approximately 4,150 square foot, single-story block warehouse building (Kokomo Auto Supply: 309 South Union Street); an approximately 22,000 square foot, three-story brick warehouse building (Kokomo Auto Supply: 315 South Union Street); and a vacant three-story brick building that totaled approximately 14,000 square feet (Lee Moore: 321 � 323 South Union Street). The remainder of the Property was developed with paved parking and areas of exposed soil. The surrounding area included a mixture of commercial and residential developments. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property except for the following: � The reported presence of VOCs, PAHs, and metals at concentrations that exceed applicable Indiana Department of Environmental Management (IDEM) Remedial Closure Guide (RCG) Screening levels in soil, groundwater, and/or soil gas on the NISCO and Lee Moore portions of the Property (Section 5.2.4); � Historical use of the Property as a manufacturing facility. In our opinion, the potential for environmental impact from unreported and/or undetected releases of hazardous substances and/or petroleum products related to the historical manufacturing operations represents a REC in connection with the Property (Sections 5.4.2 and 7.1) As discussed in Section 5.2.4, Phase II ESAs were conducted on the NISCO and Lee Moore portions of the Property to determine if the historical manufacturing operations had impacted the Property; and, � The faulty hydraulic elevator piston in the Kokomo Auto Supply building. The potential for the faulty piston to result in a leak of hydraulic oil to the subsurface environment is a REC in connection with the Property (Sections 6.4.3 and 6.4.7).

Former Use: Portions of the Property were developed by the late 1800s for industrial purposes that included machine shop and blacksmith operations. The Property was occupied between 1909 and 1916 by Apperson Brother�s Automobile Company. In later years, various industrial and commercial operations were conducted on portions of the Property that included blacksmithing, warehousing, a manufacturer of food products, a brake line cutter manufacturer, a plastic molding and machine shop, a drive though cleaner, a Union Traction Company of Indiana and later Indiana Railroad System Freight Depot, and a radiator shop. The north eastern portion of the Property is currently occupied by an auto parts business and the remainder of the Property is vacant.
