Former Use: The subject building was reportedly constructed in 1965 and included auto repair operations. The gasoline station operated on the subject property until 1980, and the USTs were taken out of service or possibly closed in place in 1983. During street improvement activities in 1983, contaminated soil was discovered in the Nichol Avenue right-of-way, and a spill report for the subject property was filed with the Indiana Department of Environmental Management (IDEM). From the early 1980s until circa 2010, the subject property was occupied by Baxter Pest Control, which conducted pesticide applications at off-site locations. In 2008, a Phase I ESA was conducted for the City of Anderson and identified the USTs as a Recognized Environmental Condition (REC). A Limited Phase II Investigation was conducted for the State of Indiana in 2009 and identified that a release had occurred from one or more of the UST systems. Constituents of concern were identified in excess of IDEM Risk Integration System of Closure (RISC) Commercial/Industrial Default Closure Levels (IDCLs). UST closure and additional investigation to delineate and evaluate the release were recommended; however, the additional activities were not authorized.
