Additional Property Attributes

RECs identified are related to historical filling and past industrial use of the Property and surrounding area, including railyard activity. The contaminants of concern (COCs) established for soil at the Property are arsenic; cadmium; lead; selenium; combined PAH BaP equivalent; DRO; and 3,4-methylphenol. The COCs are not found in groundwater. Concentrations of COCs in soil above MPCA Tier 1 SLVs mean that soil will have restricted use if removed from the Property. Site-specific cleanup criteria have been proposed based on proposed industrial use for the Property. The soil remedial response action includes excavation of soils. Conceptual plans include use as a parking area and/or laydown yard. Future development may include an office building, garage and/or warehouse and may include site grading, installation of security fencing, lighting, utilities, and general site drainage. The Property is proposed for future commercial/industrial development to support expanded port services on Rice's Point -- an area of Duluth with legacy issues related to historical waterfront industry. Property remediation will help bolster development in the area by making more industrial property available for growing businesses in the region. The Duluth Seaway Port Authority will retain ownership of the Property and enter into long-term leases with future tenants or use the Property as a temporary cargo or bulk material laydown yard for existing tenants.

Former Use: The assumed earliest development of the Property was between 1885 and 1908. Historically, the Property has been used for residential, industrial/commercial, religious worship, lumber shed, and railway-related activities. A portion of the Property was leased in 2008 for operation of a portable cement mixing facility. Additionally, a portion of the Property was "turnback" land from the Minnesota Department of Transportation to the City of Duluth (City). The Property was purchased by the Duluth Seaway Port Authority (Authority) as part of several separate land transactions. The first area (Blocks 45, 46 and up to the center line of Lynn Avenue) was purchased in December 2004 from Union Pacific Railroad. The remaining Property (portions of Blocks 38 and 47) was purchased from the City of Duluth in March 2008. The Elm Avenue right-of-way was owned by the City of Duluth until it was vacated in June 2015 and is now owned by the Authority. The Property is currently vacant; however, a large area on the southeast side is being used to stockpile 5,500-6,000 cubic yards of clean fill material. A parking lot at an adjacent building leads to a two-track dirt road which provides access into the Property. Area City municipal drinking water, gas and sanitary services do not currently extend to the Property. An overhead electrical utility line and utility poles are present on the Property. The Property is zoned Industrial General. The current use of adjoining properties include office buildings, vacant land, and state highway use.
