Additional Property Attributes

According to property ownership records, city directories, Sanborn maps, and historical aerial photographs, an automotive service station and/or filling station operated at the Site from at least 1936 until 2001 when the Site proceeded through tax foreclosure and was sold at a sheriffs sale. Based on recent Phase II ESA activities completed at the Site including a geophysical survey and exploratory excavations, three underground storage tanks (USTs) are present on the northwest side of the Site building and a former UST cavity is present on the northeast side of the Site building. Further, analytical results from the Phase II ESA indicate that Site soils are impacted with petroleum-related compounds proximate to these two current/former UST cavities.

Former Use: The BUSTR attorney reviewed the information submitted and concluded that the USTs were likely last used prior to 1984 sometime in the early 1980s - by Wylers Tire and Auto (operator). However, the Manhattan Building Company owned the property from 1940s until 1986 which means they would be a responsible party. In order for the site to be a Class C all RPs must be non-viable. The City is not eligible for the ODSA Abandoned Gas Station Cleanup Program due to the Manhattan Bld. Company being listed as a viable responsible party. BUSTR will be sending a letter to the Manhattan Bld. Co. requesting removal and closure of the USTs.
