Additional Property Attributes

Closed LUST sites are located at properties adjacent to south and east of the Property. The two LUST sites include AMPI (currently Northwest Plow and Auto Co.), and Glendenning Properties (Currently Con-way Freight). Both LUST sites have been closed by the MPCA, and determined that the remaining contamination if present does not pose a threat to public health or the environment. Neither of these two sites, or other sites identified in the regulatory database report are considered Recognized Environmental Conditions to the Property. The adjacent closed LUST at the adjacent east Northwest Plow and Auto Co. site was located within 60 feet of the Property boundary. Residual soil impacts remain associated with that closed leak site and have the potential to impact the Property if petroleum migration were to occur to the west. However, based on the reported removal of 174 tons of petroleum impacted soils (primary source of contamination), the potential for residual petroleum impacts to reach the Property as a result of the closed adjacent LUST site is considered a de minimis condition. A de minimis condition is defined by ASTM as a condition that generally does not present a threat to human health or the environment and that generally would not be subject to enforcement action if brought to the attention of appropriate governmental agencies. The review of historical use records, the Property reconnaissance, and interviews also did not identify Recognized Environmental Conditions associated with the Property.

Former Use: The Property was constructed in the early 1990s as an addition to the building adjacent to the north, which was constructed in 1981 (Kramer & Moen). Records or recollection of environmental impacts by the Property owner, and current tenant were not identified. The land use prior the construction of the building Property appears to be residential preceeded by vacant land according to city directories and aerial photographs. The structures resembling residential properties were no longer present on the 1981 aerial image provided by HIG. The land use associated with the Property after development have been an commercial electrical business, an Automotive and Truck repair shop (All in One Automotive and Trucking/Olson Brother Automotive), a construction and reuse company (Common Ground Deconstruction), and an automotive and architectural graphics design and insulation shop (Elite). Hazardous waste was likely generated while the Property was occupied by All in One Automotive and Trucking/Olson Brothers Automotive. The hazardous waste possibly generated in association with the automotive repair shop was likely; waste oil and lubricant, antifreeze, car batteries, and degreasing solvents. Obvious indications of improper disposal or use of hazardous waste materials was not identified during the Phase I ESA. An oil water separator is installed to collect oils and greases associated with the floor drains in the install area. The oil-water separator was recently pumped out and is in good working condition according to Elite.
