Additional Property Attributes

The Property is owned by Westgate Estates LLC and is comprised of two tax lots (20-03-28-31-12400 & 20-03-28-31-12500). The 0.22-acre Property was vacant with no structures and in use as a parking lot during the Phase I ESA site visit in March 2018. The Property is in downtown Cottage Grove, Oregon. The Property is zoned C2 Central Business. Historical maps show that the Property was developed for residential use by 1893. Later uses of the Property identified on historical maps include a creamery, a soda botting shop, a millinery and tailor, residential apartments, and an ice factory. Historical aerial photographs indicate that all structures were removed from the Property between 2011 and 2014. Phase I ESA found RECs related to the Property: 1) Past uses of the Property including an apartment building, creamery, and ice factory indicate the potential presence of fuel or heating oil USTs, and there's a potential for the past or current presence of USTs on the Property, and 2) Historical records indicate that the site adjoining the southeastern corner of the Property (750 E Main Street) is a former auto body shop and retail gasoline service station. The former gasoline service station is listed as LUST ID #20-12-0781 in the DEQ LUST database. Based on previous samplings and investigations, DEQ issued a conditional NFA for this facility in July 2015. The NFA letter states that petroleum constituents above DEQ screening levels remain in soil and groundwater at this site. DEQ issued the NFA under the condition that groundwater at the site may not be used for any purpose. Due to the proximity of this site to the Property and its inferred upgradient there is the potential that impacted groundwater from this site has migrated beneath the Property. Phase II ESA was completed; No release found, so no cleanup or additional sampling is necessary.
