Additional Property Attributes

The Property is owned by the Marvin Family under two business names: Too Blue, LLC (Too Blue) and 4340 LLC, and is comprised of three tax lots: 17-03-34-41-00300 (owner: Too Blue), 17-03-34-41-00200 (owner: 4340 LLC), and 17-03-34-41-00100 (owner: Too Blue). The 8.28-acre Property was vacant with no structures during the Phase I ESA site visit in March 2018. Tax lots -300 and -200, which comprise the southwestern area of the Property, were in use as a paved parking lot and construction equipment storage area for active construction on Franklin Boulevard. Tax lot -100, which comprises the majority of the 8.28-acre Property, was undeveloped during the visit. The Property is located north of Franklin Boulevard and is bordered by the Willamette River to the north and east. The Property area is zoned for commercial mixed use. A Ramsey-Waite facility supplying agricultural equipment rentals is adjacent west of the Property, and across Franklin Boulevard to the southwest is a U-Haul Moving & Storage Property. A residence and undeveloped land are located to the south across Franklin Boulevard, with Turn Key RV Rentals beyond. The southwestern area of the Property was first developed by 1910. Commercial and residential development were present by 1955. Kirkland Floral Company and various trailer and auto rental companies occupied the southwestern area of the Property along with residences from at least 1954 to 1968. Later, the Property was exclusively used by numerous equipment rental businesses through 2000. Historical city directories show that a business called Nic-L-Silver Battery Sales was present at the Property in 1964. The majority of tax lot -100 has remained undeveloped with the exception of an orchard that was present from at least 1936 until the late 1960s or early 1970s. Historical aerial photographs show vehicle storage in the southwest corner in the 1970s and 1980s, which extended onto tax lot -100 from the businesses on the adjacent tax lots -300 and -200. The Property has been vacant for approximately 20 years. Tax lots -100 and -300 were purchased by Too Blue, LLC in approximately 2000; tax lot -200 was purchased in 2012 by 2340 LLC. All buildings were demolished in the summer of 2017. In 2009 and 2010, environmental site assessments were completed by BB&A Environmental (BB&A) on each of the tax lots comprising the Property. Near surface soil sampling on tax lot -100 did not detect pesticides or herbicides. Soil and groundwater sampling on tax lots -200 and -300 detected low levels of petroleum hydrocarbons and polynuclear aromatic hydrocarbons. Based on Stantec Phase II samplings and assessments, metal, petroleum hydrocarbons, PAH, VOC (benzene) were detected in tax lot 200 and 300 soil samples, but none of them exceeded applicable RBCs. A CMMP is recommended to ensure the proper management of soils during redevelopment. Low levers of VOCs and petroleum hydrocarbons were detected in tax lot 300 groundwater samples. A CMMP is recommended to ensure proper management of groundwater during redevelopment. Comparison of analyte concentration detected in tax lot 200 soil samples to vapor intrusion into building RBCs indicates one exceedance ? Gasoline. Supplement Phase II ESA with soil gas sampling was conducted to address the data gap regarding this GRO concentration in a soil sample. No detections of analytes were reported in excess of the DEQ RBCs applicable to the Property. The results of soil vapor sampling indicate no evidence of unacceptable risk via the vapor intrusion exposure pathway for urban residential or occupational receptors. An NFA determination was issued in August 2020.
