Additional Property Attributes

This site is a former gas station and grocery store, which has been abandoned for at least two decades. The property is contaminated as a result of releases from two 10,000 gallon underground storage tanks that were removed in the early 1990's. Although prospective purchasers have contacted ADEC about the status of the property, no party has been willing to acquire the property because is it impacted with petroleum hydrocarbons (which reportedly extends offsite). In addition, the property building is derelict and needs to be demolished. ADEC has funded several investigations over the last two decades to address and characterize the petroleum release(s) at the Property. Grant funds would not be used to investigate or characterize the release from the USTs; instead ADEC has indicated Grant funds would be most beneficial to fund a regulated building materials survey, to support razing the remnants of the existing building. Once razed, the property's value would significantly be enhanced. The site is located in a prime location along the Old Glenn Highway. Redevelopment of this property would remove a blight from the area, create new jobs and benefits to the community.

Former Use: The ownership history of the Property is complex and explained in detail below, per Rebecca Convery of the Alaska Department of Law: "Randall Frank is deceased, and his interest in the property was bequeathed to his wife, Jeanette Sharon Frank, and his two sons, Scott and Randall Jr. However, due to the filing of bankruptcy proceedings, Mr. Frank�s 50% interest in the property has never been deeded to his heirs. The last recorded deed on the property is a 1989 quitclaim deed, which indicates that Randall Frank and Kathleen Frank (now Stadem) each own � undivided interest in the property. The property was awarded out of bankruptcy proceedings to Security National Trust (SNT) in satisfaction of a debt owed by Randall and Kathleen Frank against the property in the form of a mortgage. However, a deed conveying the property to SNT was never recorded. Therefore, there is no recorded instrument transferring the property to SNT, who later assigned its interest in the mortgage on the property to Foothill Capital Corp. The Department of Law has made several attempts to track down the deed that was allegedly granted to SNT as a result of the bankruptcy proceedings; however, no unrecorded deed has ever been located. Accordingly, the owner(s) of record are still Randall Frank (deceased) and Kathleen Frank (Stadem). Since Randall Frank is deceased, it is unclear whether his interest would vest in his estate, or whether the property would be considered to be abandoned from the estate, since the property was subsequently awarded in bankruptcy to a third party lender in satisfaction of a secured debt against the property. With respect to the tax deed foreclosures undertaken by Mat-su Borough, the Borough never took a tax deed on the property. Therefore, the property has never been properly transferred to the Borough, so title to the property remains in the name of Randall Frank and Kathleen Frank (Stadem). "
