Addl Cleanup/Treatment info: Remediation of NYSDEC Petroleum Spill number 1503447 which was opened on 6/29/2015 during investigation activities with regards to the petroleum impacted soil and groundwater encountered in the vicinity of the abandoned USTs. During the Project, over-excavation was performed in the area to remove impacted soil. Excavation was performed to groundwater (approximately 8 feet below grade). The final excavation was approximately 85 feet by 50 feet by 8 feet. A total of 51.96 tons of hazardous soil was removed off-site disposal. A total of 1,399.15 tons of petroleum impacted soil was removed for off-site disposal. In addition, 210 pounds of Oxygen Releasing Compound (ORC), product of Regenesis, was directly applied to the groundwater within the open excavation during tank removal for groundwater remediation. One (1) 2-inch permanent Quarterly groundwater monitoring was installed to monitoring the fate and transport of the residual groundwater contamination. Based on the groundwater sampling results to date, it appears the source removal and groundwater remediation performed at the Site has been successful in reducing the petroleum related contamination. The residual groundwater contamination is minimum and does not appear to represent a significant threat to human exposure. This spill was closed on 7/29/2019.

Recorded a Declaration of Covenants and Restrictions with the property deed with the County Clerk that includes a listing of Engineering Controls and Institutional Controls and a requirement that management of these controls must be in compliance with an approved Site Management Plan (SMP). Institutional Controls including the following: (1) prohibition of vegetable gardening and farming in residual soil; (2) prohibition of the use of groundwater beneath the site without treatment rendering it safe for the intended use; (3) prohibition of disturbance of residual soil unless it is conducted in accordance with the SMP; and (4) prohibition of higher levels of land usage than the restricted residential uses addressed by this Remedial Action without prior notification and approval by OER. The deed restriction placed on the property will also document the installation and continued operation of the active SSDS.

Additional Property Attributes

Acacia Gardens, located at 409 East 120th Street, is the Acacia Network's flagship affordable development. It is a twelve-story 179-unit affordable housing development located at the northeast corner of East 120th Street and 1st Avenue in East Harlem.
