Additional Property Attributes

The Property consists of approximately 136 acres of land and contains no permanent structures. The Property is zoned Development Holding with a future development plan for single family residential housing. Surrounding properties are single family residential to the east, vacant to the south and west, and a preserved natural area to the north. Southwest of the Property is a City wastewater treatment facility. The Property remained undeveloped until approximately 1983 when the City constructed rapid infiltration basins (RIB) on the southern portion of the Property for the purpose of wastewater treatment plant (WWTP) effluent infiltration. Use of the RIBs was discontinued in approximately 2003. Phase I ESA found 4 RECs: 1) A groundwater plume sourced from the BMI Complex is present beneath the Property. Perchlorate was detected during a recent groundwater monitoring event in shallow groundwater across the Property in monitoring wells; 2) Historical aerial photos indicate dumping of approximately 500 cubic yards of undocumented fill in the southwest corner of tax lot -005. Material threat of petroleum or hazardous substance is presence in this fill material; 3) An unlined ditch (Alpha Ditch) located adjacent to the western Property boundary conveyed wastewater from the BMI Complex to the Las Vegas Wash during the approximate time period 1942 through 1976; and, 4) Two soil samples were collected to evaluate environmental conditions within RIBs historically utilized by the City on tax parcel -003. Soil sample testing parameters included perchlorate, metals, organochlorine pesticides, VOCs, SVOCs and dioxins/furans. Multiple analytes were detected, but all at concentrations below NDEP BCLs for commercial and industrial use, except arsenic. Arsenic was determined to not be elevated above typical naturally occurring concentrations. Due to the limited nature of this soil sampling, the low concentrations of various analytes detected in Property soil was identified as a REC. Based on Phase II assessment for RIB, alpha-BHC was detected in a soil sample collected in 2013, but was below its NDEP BCL and USEPA RSL. Arsenic concentrations in soil samples were below the mean soil background concentration and appear to be consistent with naturally occurring concentrations. Cobalt concentration was below the NDEP BCL for Industrial/Commercial Worker Soil and USEPA RSL for Industrial Soil. Dioxin/furans were detected in one soil sample collected in 2013 from the southernmost RIB. The total TEQ for the soil sample exceeded the NDEP RC, NDEP BCL for Residential Soil and USEPA RSL for Residential Soil. Based on Phase II assessment for Alpha Ditch, no evidence of a release impacting Property soils associated with the former Alpha Ditch was observed. Without obvious impacts to Property soils, it cannot be definitively determined that releases
from the former Alpha Ditch have occurred as it is not possible to differentiate whether contaminants in groundwater are sourced from the Alpha Ditch or the groundwater plume that migrates beneath the Property sourced from the BMI Complex. No evidence of significant impacts to the undocumented fill on the Property was observed. While the presence of perchlorate, chloroform, and PCE in groundwater provide evidence of a release, it cannot be definitively determined whether the indicated release is sourced locally from the Alpha Ditch or from the BMI Complex. No mitigation of soil or groundwater appears necessary to facilitate Property redevelopment provided future development does not include beneficial use of groundwater. Based upon the limited scope of soil and groundwater testing conducted as part of this assessment, no barriers to residential development of the Property have been identified.
