Additional Property Attributes

The Property consists of two tax lots identified as Lincoln County tax lots 11S11W17A 00400-00 (58.79 acres) and 11S11W17A01200-00 (0.78 acres). The Property is owned and operated by the Port who leases a portion to the Rogue Ales Brewery for their world headquarters. The Rogue Ales Brewery consists of an irregularly shaped structure totaling approximately 66,000 square feet for the building footprint and an additional estimated 22,000 square feet dedicated to exterior storage and operational areas. Therefore, the total footprint of the brewery interior and exterior operations (not including parking lot) is approximately 88,000 square feet. The Property is located in the western flank of the central Oregon Coast Range; a north-south trending geanticline consisting of sedimentary (sandstones, siltstones, and mudstones) and volcanic (flows, tuffs, and breccias) units. Both the sedimentary and volcanic units are intruded by numerous dikes and sills, all of which provide the sediment source carried into the bay by the Yaquina River. Historically the Property and Project Area was a depositional estuarine tidal flat within the Yaquina River, consisting of mainly sand and silt. The Rogue Ales Brewery building is currently being supported by the seawall on its northside. The Rogue Brewery Seawall comprises steel soldier piles and concrete lagging panels tied back with steel rods to a dead-man anchor. Four decades of exposure to the marine environment have resulted in visible deterioration of many of the seawall major structural elements. This deterioration includes corrosion of the steel soldier piles and spalling of the concrete beam/pile cap. In addition, some loss of backfill material through gaps in the concrete lagging panel is apparent as material can be seen in front at the base of the seawall. It is suspected that some historical settlement of the interior floor slab of the brewery may be due to this material loss. Based on the assessment it was recommended to conduct a continuous service-life prediction by establishing the chemical and structural composition of the backfill soil behind the seawall. Several fuel spills have occurred on the Property within the South Beach Marina and Property parking lots. In 2016 an oil sheen was reported in the South Beach Marina with a strong diesel odor. In 2018, a gasoline spill was reported in the parking area of the Property. The Property is classified by the USEPA Facility Registry System (FRS) as the South Beach Dredge Material Disposal Site. The USEPA Enforcement and Compliance History Information database demonstrates NPDES permits associated with the FRS listing as the South Beach Dredge Material Disposal Site for the Property, including an active permit expiring in 2020. A review of historical aerial photographs and agency database records for the Property demonstrates chemicals of potential concern in the fill material at the Project Area may include petroleum hydrocarbons, heavy metals, PCBs, pesticides, and PAHs. Based on the Phase II assessment, no analytes were detected in soil that indicate that a significant release of petroleum or other hazardous substances has occurred from the historical operations on or near the Property. Based on this assessment and the planned use of the Property for commercial use, no indications of unacceptable risk to human health or the environment have been identified and no additional environmental assessment is recommended for the Property based on current and likely future use. If the planned future use of the Property changes or if groundwater use is anticipated, additional assessment may be warranted.
