Addl Cleanup/Treatment info: Excavation of lead contaminated soils located in Heating Oil and Lacquer Spill Area of site as identified in the Risk Evaluation/Response Action Plan dated 1/26/23 - Excavation conducted and total of 756.55 tons of lead contaminated soil was hauled to and disposed of at the Dubuque Metropolitan Area Solid Waste Agency on 8/23/23-8/24/23. Clean fill material was brought to the Site to replace the excavated material. Fill material graded to match existing surfaces and to restore overland flow to pre-excavation conditions. Environmental covenant drafted and approved/signed by IA DNR to restrict groundwater usage on site.

Flexsteel Industries, Inc and IA DNR entered into environmental covenant on property located at 3400 Jackson St, Dubuque (see recorded deed for completed legal description). Property is subject to following use limitations and terms: Groundwater well installation and use is prohibited. Residential use is prohibited. If soil disturbance below a depth of two feet from the ground surface is necessary, a soil management plan must be submitted to and approved by the IA DNR. Future structures must incorporate vapor barriers. IA DNR issued a NFA 6/20/24 with institutional covenant notated in it.

Additional Property Attributes

This site had been a manufacturing facility since 1897, with operations for millwork, portable batteries, and most recently Flexsteel Industries, which manufactured furniture for home, office, and recreational vehicles and boats. Flexsteel closed the facility at the end of 2017, and left many large, antiquated and inefficient manufacturing buildings sitting empty. As the City of Dubuque did not want to see the facility deteriorate any further, and as they hoped to plan for a new, mixed-use approach to the 42 acre site, the City entered negotiations to acquire the site from Flexsteel, and the City would use its economic development 'land bank' entity, Jackson Street Redevelopment, LLC to do so. As the LLC anticipated in-depth environmental assessment, potential clean up, and large-scale building demolition, they sought Iowa DNR 128(a) assistance with pre-acquisition environmental due diligence. A Phase I ESA was completed on behalf of the LLC; however, Flexsteel's corporate direction and planning changed, and the corporation decided not to continue negotiations with the LLC or the City for property sale or transfer. Further 128(a) assistance has been halted for this project. The property is enrolled voluntarily in the Iowa Land Recycle Program.
UPDATE: In 2021, the corporation decided to donate a portion (15-20 acres) of the property to the Dubuque County Conservation Board for expansion of its wetland areas and exhibits, realignment of the county bike trail and fencing that are currently adjoining the property. The County requested assistance from ECIA to complete its due diligence on the site. ECIA under the ECIA US EPA Brownfields Assessment program funded a new updated Phase I. Further investigation was recommended. A Phase II was conducted on a sliver of property along the bike trail and based on the results of soil sampled in this small area no further assessment is recommended for this portion of the property approx 1,200 sf of land in southeast corner of the Former Flexsteel site. The entire property remains in the IA DNR Land Recycle Program as of 7/2023. Groundwater monitoring completed in April 2023 and a RERA was submitted to IADNR in January 2023 and approved by IADNR in August 2023. Lead Contaminated soil was excavated and removed and replaced with clean soil in August 2023. Lead contaminated soil levels are below acceptable levels for industrial use as a result of the cleanup. Environmental covenant recorded in May 2024 restricting residential use of site. In June 2024 IA DNR issued NFA with institutional covenant restrictions.
