The implementation of Activity and Use Limitations (AULs); establishing safety protocols to minimize potential exposure risks for both future occupants and construction/excavation workers; or a combination of these measures. If a volunteer intends to seek a Covenant Not to Sue (CNS) under Ohio?s VAP and wishes to keep the future drinking water ingestion pathway classified as incomplete, an AUL restricting groundwater use through the establishment of an Environmental Covenant (EC) will be necessary. Additionally, the predicted concentration of tetrachloroethylene (PCE) in indoor air exceeds the VAP Residential Indoor Air Standard. If any of the existing buildings on the property are to be reused, it is recommended to conduct indoor air testing to verify or contradict the data generated from the Vapor Intrusion Site-Limited (VISL) modeling. Alternatively, remedial activities or engineering controls should be implemented to ensure that the vapor intrusion (VI) pathway to indoor air is acceptable or classified as incomplete.

Additional Property Attributes

2021: This site housed the former Dave's Supermarket, consisting of a market building and 3 parking lots. A Ph II was conducted on one parking lot to determine if vapor intrusion might become an issue in new construction (no issues found). The other parking lots and the building may need further evaluation to determine if they are ready for redevelopment.

Ohio EPA 4/16/2025 Update: The Subject Property includes five parcels totaling 2.68 acres, divided by Payne Avenue and East 33rd Street. The northern section (Cuyahoga County parcel #102-29-052) covers 1.26 acres and contains a vacant 43,000-square-foot building from 1957, bordered by East 34th Street and East 33rd Street. The southeast section (Cuyahoga County parcel #102-37-001) is 0.93 acres with an asphalt parking lot, bordered by Payne Avenue, East 36th Street, Webster Court, and East 33rd Street. The southwest section (Cuyahoga County parcels #102-35-011, 102-35-012, and 102-35-013) consists of 0.508 acres with another asphalt parking lot, bordered by Payne Avenue and East 33rd Street. The north and southeast sections of the Subject Property were previously occupied by Dave's Supermarket and its parking area, while the southwest section serves as a community gathering space and parking lot. Access is available via Payne Avenue and several streets. The subsurface soil contains arsenic, lead, and benzo(a)pyrene above Ohio VAP criteria for residential and commercial uses. To mitigate exposure, strategies may include active remediation, Activity and Use Limitations (AULs), and safety protocols for future occupants. Groundwater testing shows elevated levels of metals in monitoring wells, but the property is within a verified Underground Source of Drinking Water zone, indicating groundwater isn't used for drinking, making that exposure pathway incomplete. To maintain this classification while seeking a Covenant Not to Sue (CNS) under Ohio's VAP, an AUL restricting groundwater use through an Environmental Covenant (EC) is needed. Additionally, predicted indoor air concentrations of PCE exceed VAP standards, so indoor air testing or remedial measures are recommended for reused buildings to ensure the vapor intrusion pathway is acceptable.
