Additional Property Attributes

The Property consists of approximately 6 acres of land covered with grass, asphalt, and gravel. The area surrounding the Property is developed with a mix of commercial, industrial, and residential properties. The approximate coordinates of the Property are 39� 13' 31.22" north latitude and 84� 27' 00.85" west longitude. The Property slopes downward from the southwest corner to the northeast corner. The approximate elevation ranges from 568 to 559 feet above mean sea level (amsl).
Certified Professional Mr. Keith Egan (CP #259) issued NFA Letter (12NFA466) and the Property was issued a Covenant Not to Sue on November 29, 2012. Due to limitations in funding, the 2012 investigation did not include soil gas collection and analysis.
The Environmental Restrictive Covenant restricted building occupancy because a soil gas survey was not conducted. The Property also has commercial, industrial, and groundwater use restrictions. The building restriction stated: A building will not be occupied on the Property unless a vapor intrusion or mitigation system such as a sub slab depressurization system is present and approved by Ohio EPA to prevent exposure to volatile emissions to indoor air from contaminated soil or ground water in excess of applicable standards and it is operated and maintained as an engineering control under an operation and maintenance agreement in accordance with a covenant not to sue issued by the Director of Environmental Protection pursuant to ORC � 3746.12.
According to the March 2016 Ohio EPA guidance, Activity and Use Limitation Under the Voluntary Action Program, Prior to human occupancy of any building constructed on the Property, either: (i) a remedy that eliminates indoor air vapor intrusion exposure to hazardous substances in soil or ground water in excess of applicable standards shall be installed, operated and maintained as an engineering control under an operation and maintenance agreement in accordance with a covenant not to sue issued by the director of environmental protection pursuant to ORC 3746.12; or (ii) a demonstration attested by a certified professional shall be made to Ohio EPA, that the Property complies with applicable standards for the vapor intrusion to indoor air exposure pathway without further implementation or remedial activity and documented in accordance with ORC chapter 3746 and the rules adopted under the chapter.
The vapor intrusion investigation discussed in this report represents the demonstration by a certified professional to Ohio EPA that the Property complies with applicable standards for the vapor intrusion to indoor air exposure pathway without further implementation or remedial activity. The certified professional demonstrates in this report that vapor intrusion is not a pathway of concern and a mitigation system is not needed to occupy the building. The cumulative risks from direct contact with soil and vapor intrusion do not exceed 1. As such, the building occupancy restriction can be eliminated along with the encumbrance to redevelopment it presented.
