Additional Property Attributes

The Subject Property consists of two legal parcels of land (one addressed as 600 Martin Luther King Jr. Drive and one unaddressed parcel), occupying approximately 0.215 acres. The Subject Property was developed for residential purposes prior to 1899. Sometime between 1917 and 1922, the residential dwelling and auxiliary structure on the 600 Martin Luther King Jr. Drive parcel was razed and the parcel was redeveloped with a gasoline filling station. Sometime around 1938, the residential dwelling on the unaddressed East Mason Street parcel was razed and the unaddressed East Mason Street parcel was utilized as a used car lot in the late-1930s through early-1940s. The gasoline filling station operated from between 1917 and 1922 until 1965, when the gasoline filling station was razed. The Subject Property has not been utilized for any specific purpose since that time. Presently, the Subject Property is not currently developed with any structures, and consists of earthen drives/parking areas, concrete sidewalks and approaches, and areas of landscaped vegetation.

The Phase I ESA revealed no evidence of Recognized Environmental Conditions (RECs) in connection with the Subject Property, except for the following:
* The 600 S. Martin Luther King Jr. Drive parcel of the Subject Property operated as a gasoline filling station from approximately 1917 until 1965, when the gasoline filling station was razed.
* The 118 E Mason Street parcel of the Subject Property operated as a gasoline filling station from the late 1930s to mid-1940s.
* The southern adjoining property at 616 S. Martin Luther King Jr. Drive operated as an automotive garage with automotive sales/service and glass sales/service operations from between 1922 and 1928 through the 1980s.

The Phase II ESA results indicate the presence of petroleum-based impacts to soil and/or groundwater on the 600 South MLK Jr. Drive and 118 East Mason Street parcels in excess of GRCC consistent with the historical gas station operations on these two parcels. Select metals were identified in soil and/or groundwater on the three parcels with the concentrations of select metals in soil and/or groundwater in excess of GRCC. The identification of metals in soil and groundwater is presumably attributable to the presence of fill material in shallow soils and turbidity during collection of the groundwater samples. Select VOCs were identified in sub-slab soil gas in excess or Residential VIAP screening levels. The identification of VOCs in excess of Residential VIAP may in-fact be attributable to the laboratory analytical process.

The presence of petroleum-based VOCs, PNAs, and metals in soil and groundwater above EGLE cleanup criteria demonstrates that the parcels meet the definition of a "facility" as defined by Part 201 of NREPA.

The GPR results indicate the apparent continued presence of two USTs on the 600 S. MLK Jr. Dr. parcel. Based upon the former use of the site as a gasoline station the USTs are reasonably concluded to be subject to regulation. Further assessment/response is necessary relative to regulated USTs, including verification of the presence of tanks, registration of tanks with the State, disposal of any tank contents, removal of the tanks from the property, and the completion of UST Site Assessment sampling.
