Additional Property Attributes

The disposal site/subject property is a three-acre wooded area, located on a portion of a larger parcel of a property owned by the Department of Corrections (DOC). The site is the location of the former Rainbow's End Playground (the "Playground") and is currently vacant. The disposal site is in a residential and recreational use area. Site assessments commenced in 2020 and have identified arsenic in the shallow soils at concentrations ranging up to 264 milligrams per kilogram (mg/kg), which could pose an Imminent Hazard to human health [310 CMR 40.0321(2)]. This area is currently fenced to prevent access to the impacted soils. The source of the arsenic impacts in soil appears to be the former pressure treated wood play structures. According to the 2020 Massachusetts Environmental Justice Map Viewer, the property is located within a minority and income EJ Block Group. The PRP is the Town of Bridgewater (the "Town"). The Town has a history of licensing the subject property from the DOC every five years. The DOC did not play any role in the design, construction, operation, and/or maintenance of the Playground. The limited site investigation to characterize soil is complete. Permitting and planning to support remediation is underway. Remediation will include removal of the arsenic-impacted soils.
