Additional Property Attributes

The Subject Property consists of two contiguous legal parcels occupying approximately 5.31 acres. The northeastern parcel is owned by Consumers Energy while the southwestern parcel is owned by the City of Jackson. The Subject Property is currently not developed with any structures and is the Workers Memorial Park, a grass covered public park with tree cover present on the eastern and southern portions. The Subject Property was formerly associated with historical Consumers Energy Manufactured Gas Production (MGP) operations that were focused offsite to the north, east, and northeast. The MGP site began operations in 1887, was placed on standby status in 1942, and was retired in 1947 with the gas holder ASTs remaining in use until 1956. Consumers operations on the Subject Property appear to have been limited to the presence of a 1,500,000 cubic foot gasometer AST containing natural gas that was installed on the existing Consumers Energy parcel in the early 1900s and removed in approximately 1960.

The Phase I ESA revealed no evidence of Recognized Environmental Conditions (RECs) in connection with the property except for the following:
* Historical Consumers Energy Manufactured Gas Plant (MGP) operations from approximately 1908 to approximately 1960.
* The presence of an automotive repair garage on the western boundary of the City of Jackson parcel from approximately 1930 to 1960
* The presence of three soil mounds along the eastern boundary with MGP-related metals and PNAs impacts identified in association with each of the soil mounds.

The Phase II ESA identified the presence of petroleum-based VOCs & PNAs, metals, and cyanide in soil and the presence of lead in groundwater above EGLE residential cleanup criteria demonstrates that both parcels of the Subject Property meet the definition of a "facility" as defined by Part 201 of NREPA.
