Additional Property Attributes

wo brownfield properties, known as the Marina District (07NFA258) and the Arena District (09NFA342) are located to the west of the Subject Property. These properties were issued Covenants not to Sue (CNSs) by the Director of the Ohio EPA in 2008 and 2010, respectively. Historically, these former brownfield properties were used for a variety of commercial and industrial purposes, the most recent uses being a sports arena and a coal-fired electrical generating plant. Several fly ash ponds were located on the properties and were filled with coal ash and residuals as a direct result of the generation of electricity. Documentation prepared and submitted to the Ohio EPA in pursuit of the CNSs indicates that the primary contaminants on these brownfield properties consist of polycyclic aromatic hydrocarbons (PAHs), volatile organic compounds (VOCs), and metals. This documentation also indicates that approximately 60,000 cubic yards of fly ash and VOC-contaminated soils were excavated from the 07NFA258 Marina District and 09NFA342 Arena District brownfield properties, consolidated at the Subject Property, and capped with at least two feet of clean soil. Accordingly, there does not appear to be an unacceptable risk resulting from vapor intrusion (VI) to indoor air at the Subject Property and the data indicate that the subsurface soil samples meet Ohio VAP GNSs within the Residential Land Use Generic Point of Compliance2 (POC). Based upon these data, the Subject Property appears to be appropriate for redevelopment for the intended purpose of developing an urban camping facility.
