Additional Property Attributes

The Subject Property consists of three legal parcels occupying approximately .85 acres. The Subject Property is currently developed as a tobacco shop and cigar lounge. Historically, the Subject Property was developed as a residence from 1908 to the mid 1950s. From the late 1950s to the late 1980s, Sherwin Williams operated out of the Subject Property. For the entirety of the 1990s, the Subject Property was occupied by various commercial rental agencies, an aquatic pet store, and copy/stereo store. Smokes on Burdick has been operating at the Subject Property since at least 2001.The following Recognized Environmental Conditions (RECs) were identified in in the Phase I ESA: 1) A 2000 subsurface investigation conducted by DEQ (now EGLE) of a former filling station located at 1209 South Burdick Street (80 feet northeast of the Subject Property) identified volatile organic compounds (VOCs) in soil and groundwater that exceeded Part 201 Generic Residential Cleanup Criteria (GRCC) / Part 213 Risk-Based Screening Levels (RBSLs). The closest sample location relative to the Subject Property is located approximately 90 feet northeast of the Subject Property boundary. According to a DEQ (EGLE) Interoffice Communication for the sampling event, dated November 2000, DEQ (EGLE) reported that, ".groundwater contamination is present at the south and west property lines and is very likely migrating off site." in a southwesterly direction toward the Subject Property; therefore, the potential exists that contaminated groundwater has migrated onto the Subject Property, which is considered a REC. 2) Due to intensive, long term groundwater pumping at the City of Kalamazoo Central Wellfield #1, groundwater contamination (notably chlorinated solvents) has been drawn to the north towards the Subject Property. Due to the close proximity (approximately 300 feet) of the Subject Property to the impacted well field and lack of readily available current data, the proximity of reported groundwater impacts relative to the Subject Property is identified as a REC.

Phase II ESA activities conducted to investigate the RECs included the completion of five soil borings, evaluation of soils for potential impact, development of three temporary groundwater wells and two soil gas probes/wells, and the collection of three groundwater samples, two soil gas samples, and QA/QC samples. Based upon the results of the investigation, the Subject Property is not considered a 'facility', and no further investigation is recommended at this time.

A Hazardous Materials Inspection (HMI) survey was completed on September 30, 2024. The HMI Survey identified multiple asbestos containing materials. The survey also identified lead in paint.
