Additional Property Attributes

The subject property is located at the Katahdin Regional Industrial Park (formerly East Millinocket Industrial Park) in East Millinocket, ME. This parcel is 4.04 acres in size and is currently owned by the MCC. The subject property is primarily forested with approximately one acre within the western and central portion of the property previously cleared for a proposed development. Historically, the site consisted of vacant land owned by the Great Northern Paper Company (GNP) and its successors. The Town of East Millinocket originally acquired the property from the Katahdin Regional Development Corporation (KRDC) in 1990, following its sale to KRDC by the Great Northern Nekoosa Corporation (a successor to GNP) that same year. The Town of East Millinocket's acquisition of the land was conducted in accordance with the standard of care for real estate industry transactions at the time.

The property subsequently remained vacant until it was sold to Greenbush, LLC (Greenbush) in 2007. According to a Phase I ESA prepared in November 2022 by Stillwater Environmental Engineering, Inc. (SEE), on behalf of MCC prior to its acquisition of the property, Greenbush constructed a 2,500 square-foot industrial structure circa 2007/2008 and subsequently demolished the structure after 2019. A portable shed structure was also installed on the property during the time that Greenbush, LLC owned the property.

In January 2022, the property was reverted back to the Town of East Millinocket through an involuntary taking and subsequently acquired by MCC in November 2022, after it was found through a legal decision by the State of Maine District Court that the previous owner (Greenbush) "breached the condition of its deed by failing to develop the land in accordance with their development proposal." The property is currently vacant in the industrial park awaiting redevelopment.

According to the Phase I ESA prepared by SEE in November 2022 on behalf of MCC and prior to its acquisition of the subject property, during the ownership of Greenbush from 2007 to 2021, a 2,500 square-foot industrial structure was constructed on the property, which was subsequently demolished, and waste debris containers and building demolition materials were deposited on the property. The November 2022 Phase I ESA identified the "likely presence of petroleum products due to likely release" as a Recognized Environmental Condition (REC) associated with the subject property. In addition, the potential presence of hazardous materials related to building demolition debris formerly located on the property is considered a potential environmental concern. These environmental concerns are attributed to the operations of Greenbush from 2007 to 2021.
