Additional Property Attributes

A Phase I Property Assessment (Phase I PA) was conducted by Partners Engineering and Science, Inc. (Partners) on July 15, 2024. The Property, originally developed with two residential structures in the 1950s, was demolished in the early 1960s. By 1970, the eastern portion of the Property had been paved, and a 432-square-foot single-story commercial building was constructed in 1987. The Property operated as a gas station from 1987 until at least 2009 and has since been abandoned and blighted. The Property inspection identified former gas station features, including two dispenser islands, four pumps, an awning, and a convenience store. In April 2024, the Trumbull County Land Reutilization Corporation acquired the Property.

The Phase I PA identified six areas of concern on the Property in accordance with OAC 3745-300-06(E)(1), as follows:

IA-01: Three 10,000-gallon gasoline USTs.
IA-02: Dispenser island #1.
IA-03: Dispenser.
On October 29, 2024, Brownfield Restoration Group, LLC (BRG) conducted limited Phase II sampling and analysis, confirming three USTs on the Property. As per BUSTR regulations (OAC 1301:7-9-12(E)), out-of-service USTs must either be removed or closed in place.

Soil sample results showed no contaminants of concern (COCs) concentrations above Ohio EPA VAP DCSS. However, benzo(a)pyrene was found above BUSTR Site Check Action Levels in the 0-2' depth sample from boring B-8, and benzene and naphthalene exceeded BUSTR Site Check Action Levels in the 2-4' depth sample from the same boring. These results suggest a release from the UST system, likely from the dispenser and/or product piping near the eastern pump island.

No shallow groundwater was encountered in the unconsolidated section beneath the Property, and bedrock drilling was not conducted. As such, the environmental impact on potential bedrock aquifers remains unknown.

For the Property to achieve No Further Action (NFA) status, the USTs would need to be properly closed in accordance with OAC 1301:7-9-12. The exceedances of BUSTR Site Check Action Levels must be addressed through either BUSTR Corrective Action (OAC 1301:7-9-13) or Ohio EPA's Voluntary Action Program (VAP) (OAC 3745-300). Participation in the VAP requires a Class C determination from BUSTR, demonstrating that no viable responsible party is available to address the release.
