Additional Property Attributes

The subject property is a
0.25-acre, square-shaped parcel with an approximately 1,000 square-foot convenience
store, with detached canopy and four fuel dispenser islands. The subject property can be
accessed from the east by Eureka Street and the south by Highway 6. The subject property
contains four underground storage tanks (UST): premium gasoline, ethanol-free gasoline,
regular gasoline, and diesel. The subject property was first developed circa 1932 with a
single dwelling. The subject property was later purchased in 1960 by D-X Sunray Oil
Company with the current structure and property use layout shown in 1975 aerial imagery.
The current owner acquired the subject property in 2006.
The surrounding properties to the north are residential and the properties to the east, south,
and west are commercial properties. The west adjoining property is a dry-cleaner and the
south-east adjoining property is a tire and muffler shop.
This assessment has revealed the following recognized environmental conditions (REC),
controlled recognized environmental conditions (CREC, and/or significant data gaps
(SDG) in connection with the subject property:
? D-X Sunray Oil Company. The title records show the subject property was owned
by the D-X Sunray Oil Company in 1960. Historical imagery confirms the
establishment of a building with canopy dating back to at least 1975. The use of the
subject property as a filling station predates Underground Storage Tank rules and
regulations as well as spill prevention requirements; therefore, past releases are
likely and would not have been reported. The use of the subject property as a
petroleum fuel dispensary predating spill prevention and reporting regulations
represents a REC.

? Underground Storage Tanks. The subject property currently operates a total of
four USTs (10,000-gallon regular gasoline, 6,000-gallon ethanol free gasoline, 4,000-
gallon premium gasoline, and 2,000-gallon diesel). The site has been the subject of two
LUST events. The first LUST event began on December 9, 1996, and was closed
on April 25, 1997. No description of remediation was given. The second LUST
event started on February 11, 2020, and ended on July 22, 2020. Both LUST events
received NFA statuses and Mississippi Groundwater Protection Trust Fund
eligibility was not determined for either event. A November 2019 MDEQ
inspection revealed evidence of a leak from the petroleum storage tanks. MDEQ
required a 10-day bailing program be implemented to evaluate the status of the
leak. After the conclusion of the 10-day bailing event, no product was detected in
any of the observation wells. Additionally, leak detection tests did not indicate line
or tank failures were present within the UST system. After completion of the leak
detection tests, submittal of relevant records, and confirmation of compliance
status, the site was issued a NFA letter dated July 25, 2021. Due to the NFA
statuses, the past two LUST events do not represent a REC. Although USTs on the
subject property are in compliance, there still remains a likelihood of a future
release from the USTs; therefore, they represent a REC.
? Tennessee Gas Pipeline/CS 63. The database report lists the Tennessee Gas
Pipeline on the SEMS with a discovery date of October 11, 1988. The site is
located 65 feet east of the subject property and is located on the east adjoining
property. The site is not listed on the NPL and is identified as "potentially
contaminated." The database also states that no further remedial action is planned,
and the site has been referred for removal. Based on the Tennessee Gas Pipeline/CS
63 site's close proximity and no data regarding contamination or remedial measures
taken to date, the site is considered a REC.
? Klean-N-Press. The 1998 historical record shows the west adjoining property to
contain the Klean-N-Press (dry-cleaner) site. During the site inspection, the Klean-
