Additional Property Attributes

Concerns were raised by local citizens about the possible existence of a former manufactured gas plant MGP located on or near the site. The Phase I ESA found no RECs at the property and confirmed that 2 former MGP sites in the area are downgradient of the property. Devon Energy is constructing a new corporate high rise on this site, with plans of occupying the building in 2012. This is the first new skyscraper in downtown Oklahoma City since the early 1980s. Devon Energy financed a Phase II which was completed 8/15/08cost of this investigation is unknown. Some contamination was documented & additional sampling recommended. Subsequently, there was a confirmed release of petroleum gasoline from a storage tank located at this location, OCC PSTD case 064-3542. In September 2009 soil samples collected as part of a Phase 2 assessment found contaminated soils. This was reported to the OCC and a Confirmed Release letter was issued on September 25, 2009. The Oklahoma City Urban Renewal Authority was the property owner at the time contamination was discoverd. Contact person was Mr. Joe Van Bullard, Executive Director. The case moved forward as usual with all regulatory requirements being met. The OCC required a Remediation Action Plan be submitted for cleanup. The submitted plan was approved by OCC on November 17, 2009. The actual time for the dig and haul field work was five days starting on Monday November 30, 2009 and ending on Friday December 4, 2009. Actual amount of contaminated soil removed was 6,280 cubic yards along with 61,814 gallons of contaminated water disposed. The case was closed on August 4, 2010. Devon Energy became the owner of the property and agreed to pay for the cleanup costs and seek reimbursement from the OCC's Indemnity Fund at a later date. This was due to the ongoing construction schedule at this site. The Indemnity Fund obtained a court order to reimburse Devon on a monthly bases till all claims are paid due to the reduced cash flow in the Indemnity Fund. As of October 9, 2010, with the 6 story rotunda at the base done, the tower was fourteen stories tall and workers are now adding 1 story every ~8 days. The Devon Tower will also hold the title as the tallest in the state, besting Tulsa's 667 foot BOK Tower, and will rank with the tallest skyscrapers west of the Mississippi, just short of the tallest in Dallas, Bank of America Plaza. On a national level, it would currently rank in the top 30.

Former Use: The current site consists of several parcels that were once the core of downtown Oklhaoma City's thriving commercial district. The area succumbed to blight and eventually all the structure were razed by the OKC Urban Renewal Authority in the 1960s or 1970s. A large parking garage was constructed onsite in the 1980s. Past uses include a variety of commercial activities such as hotels, department stores, movie theaters, parking structures, offices, and an interurban trolley terminal.
