Additional Property Attributes

Representatives of UER and GEOTEK conducted a Site reconnaissance on December 9 through 17, 2008. The weather varied from warm with clear skies to cold with snowfall. The rectangular shaped Site consists of one (1) parcel, encompassing less than 0.5 acre of land. Access to the Property is available from East Sahara Avenue adjacent to the north of the Property, and Karen Avenue adjacent to the south of the Property. The Site is occupied by a one-story building. GEOTEK did not observe obvious indications of hazardous materials use or waste generation at the Site, beyond standard household-strength cleaning products. No spills or stains were observed on the subject Site during our reconnaissance. No pungent or acrid odors were observed emanating from the Site. The Site is in an area characterized by commercial and retail businesses and residential developments. The Property is occupied by several buildings which house retail businesses and office space. Several retail businesses and office buildings border the Property to the north, beyond East Sahara Avenue. South of the Property is a residential area. To the east, the Property is bordered by a bank and grocery store. West of the Property is a residential area. The Property was listed on the environmental database report obtained for this assessment as Sierra Cleaners, Tiffany Cleaners (at two locations), and Former Chevron Service Station. These facilities are listed on the RCRA Generators database, the FINDS database, the HAZNET database, and the LUST database. No releases or clean-ups have been reported for Sierra Cleaners or Tiffany Cleaners. However, as these businesses have been on the Property for many years, and based on our experience with such facilities, it is likely that soil and groundwater has been impacted beneath the Property from these businesses. Soil and groundwater beneath the Property were impacted by gasoline from the Chevron Service Station. The soil and groundwater have been investigated and the impact was deemed minimal. The Chevron Service Station was issued �Case Closed� status in June 2002. This Phase I Environmental Site Assessment has revealed evidence of historic recognized environmental conditions at the subject Property. Two dry cleaning facilities have been located at various locations on the Property. Also, a Chevron Service Station was located on the Property with documented releases to the soil and groundwater. UER and GeoTek recommend a Limited Phase II Environmental Site Assessment be conducted across the Property to determine if the soil and/or groundwater beneath the Property have been impacted. Following the review of additional information, a Letter of Addendum was issued by UER on September 8th, 2009 which stated: "...upon further review of the reasonably ascertainable records at the Nevada Division of Environmental Protection (NDEP), we no longer recommend a Limited Phase II Soil and Groundwater Investigation of possible soil and groundwater impact due to documented petroleum releases at the Chevron Service Station formerly on Site due to the following reasons: 1) Analytical results presented in a Brown & Caldwell A-K Closure Request presented to NDEP dated June 3, 2002 show one of six composite soil samples collected on Site to exhibit slightly elevated (170mg/kg) total petroleum hydrocarbon concentrations above the regulatory action level of 100mg/kg and one of six groundwater samples exhibit slightly elevated benzene concentrations (5.7 ug/L) above the regulatory action level of 5ug/L. 2) There are no drinking water or irrigation wells within 1-mile of the subject Site. 3) The identified residual impacts to the soil and groundwater appear to be limited to a small pocket near the former western dispensing island and former UST excavation, respectively. 4) Our knowledge of local soil and groundwater conditions, as well as the environmental fate of the chemical constituents in question, leads to our conclusion that any residual im
