Additional Property Attributes

The Site consists of one 7.64-acre parcel, identified as tax parcel identification number 0140-8156. The Site premises are improved with an approximately 1,584 square-foot one story commercial building, gravel parking areas, and undeveloped land with small stream and a pond. The surrounding area is primarily agricultural and residential with interspersed commercial properties along Highway 20. Farmland and agricultural land were located to the north, east, and west, with a motel (Horseshoe Inn) to the south. The Site has been reused as a veterinary practice.

The property historically supported Nite Owl Truck Stop gas station from the 1970s until the mid-1990s when it ceased retail fuel operations. In November 2006 this facility had a
reported release of gasoline and diesel fuel in soil and shallow groundwater. Three USTs were decommissioned by removal in July 2007. During decommissioning, shallow
groundwater (between 5-8 feet bgs) showed obvious petroleum impact. Due to nearby private drinking water wells, an additional Site Investigation was conducted by ODEQ in
October 2009. This investigation identified soil and groundwater contamination that exceeded generic RBCs. However, it was determined that the contamination was confined
within the Subject Property's boundaries and not migrating off-Site. Based on the analytical concentrations and absence of off-Site migration, ODEQ granted a CNFA in September
2011 which implemented an institutional control (or land use restriction) in the form of a deed restriction. The deed restriction prohibits residential use, limits drinking water wells,
and stipulates specific actions that must be taken in the event of subsurface excavation activities.
