27-0002-0048-0000, #20-27-0002-0049-0000, #20-27-0002-0050-0000 from Andre Haikal, #20-27-0002-0039-0000
from Nitro Supermarket Inc., #20-27-0002-0051-0000, #20-27-0002-0052-0000, #20-27-0002-0064-0000 from Stuart
Caldwell Jr., Harvey D. Peyton, and Rita Morris as Trustees, #20-27-0002-0054-0000 from Rex & Valerie Nelson, #20-
27-0002-0063-0000 from Eugene Aliff Jr., by virtue of a deed recorded in 2023. The subject property consists of ten
parcels of land located in a mixed-use area in Nitro, Kanawha County, West Virginia.

The subject property is zoned as mixed-use commercial/residential and is currently undeveloped. There are no structures
currently located on any portion of the subject property.
The subject property is bordered to the north by 25th Street with commercial and residential properties beyond, to the east
by a residential property with 2nd Avenue beyond, to the south by 23rd Street with commercial and residential properties
beyond, and to the west by 1st Avenue with the railroad beyond.
Based on the findings of the Phase I ESA, five (5) recognized environmental conditions (RECs) were identified for the
subject property and are summarized below:
* The EDR Radius report identified Spirit Services Nitro, a chemical manufacuring facility, as having a
violation with an unknown compliance status near the subject property. Due to the potential contamination
from the hazardous chemicals this site is considered a REC in connection with the subject property.
* The EDR Radius report identified the Old Taxi Stand, a transportation facility, as being at a higher elevation
than the subject property. Due to topographic positioning and the unknown tank status of a UST, potential
contamination from petroleum products are considered a REC in connection with the subject property.
* The EDR Radius report identified Aqua Clear Nitro Warehouse, a chemical manufacuring facility, as having
a violation with an unknown compliance status near the subject property. Due to the potential contamination
from the hazardous chemicals this site is considered a REC in connection with the subject property.
* The EDR Radius report identified Dana Transport, a bulk transportation facility, as being at a higher elevation
than the subject property. Due to topographic positioning and the generation of large quantities of hazardous
waste, potential contamination from migrating waste is considered a REC in connection with the subject
property.
* Railroad tracks were identified immediately adjacent to the west of the subject properties across 1st Avenue
on the 1928, and 1940 Sanborn Fire Insurance maps as well as aerial photos from 1957 through 2020 and
current observations during the site visit. According to a historic file review, the New York Central Railroad
operated in Nitro, WV from approximately 1922 to 1968. The railroad is currently operated as the Kanawha
River Railroad. The release of contaminats that may have migrated from the railroad tracks to the subject
property is considered a REC in connection with the subject property.
