Additional Property Attributes

The Kansas Department of Health and Environment (KDHE) most recently conducted Phase I Brownfields Targeted Assessments (BTAs) at the Western Building (ACRES ID No. 166202) and Western Tower Properties (ACRES ID No.166203) in Fort Scott, Kansas. The BTAs were conducted for the City of Fort Scott to evaluate two adjoining abandoned historical properties, encompassing 0.58 acres, proposed for redevelopment into an apartment complex. These properties were previously assessed in September 2013; however, an updated Phase I environmental site assessment was necessary to incorporate the new ASTM 1527-13 Standard and facilitate property transfer. The City of Fort Scott has partnered with Fort Scott Housing Partners LP to purchase the properties through a tax sale which required updated Phase I�s. The updated Phase I was performed for both properties in June 2014 and September 2015. Based on these Phase I reports, no evidence of �Recognized Environmental Conditions� (RECs) were identified relating to the subject properties. While RECs were not identified during the 2014 and 2015 Phase Is, it is important to note previous assessments have been performed on the properties including: 1) Phase I ESA, report dated September 3, 2013. RECs were identified as petroleum contaminants associated with the historical use of the west �tower� property and the north and northwest adjacent properties as filling stations and hazardous substances associated with a former dry cleaner facility located near the Site. 2) NESHAP Asbestos Building Survey and Limited Mold Investigation were also conducted concurrently with the 2013 Phase I assessment. Asbestos containing material (ACM) was identified in both buildings impacting approximately 94.5% of the total combined interior space. Abatement will be required prior to any demolition, renovation, or other construction work associated with the buildings to ensure regulatory compliance. Results of the mold investigation suggest widespread mold growth throughout most of the combined interior space. At least 40% of the interior walls and ceilings of both buildings contain obvious and visible black mold contamination. 3) Phase II ESA, report dated November 15, 2013. Based on results of the Phase II investigation, no contaminants of concern were identified on the subject properties and further investigation was not warranted. 4) An Analysis of Brownfields Cleanup Alternatives (ABCA), report dated March 17, 2014 was generated to evaluate to cleanup options to address the hazards identified on these properties (i.e., extensive asbestos and black mold issues). The City intends to use the ABCA to assist with researching and securing funding sources for cleanup which may include applying for an EPA 104(k) Cleanup Grant. Based on results of the most recent Phase I BTAs and considering previous assessments results, KDHE hereby clears these properties for redevelopment. During redevelopment, the City was advised to work with the KDHE Asbestos Control Section to comply with all Federal and State regulations with respect to the asbestos. Given the extent of the mold characterized visually and confirmed with tape lift samples, removal of all porous interior materials is also likely needed to safeguard public health and safety concerns associated with mold exposure.
