Additional Property Attributes

The site formerly known as Jo Ja's Superette formerly operated as a retail gas station and
convenience store and contained three 6,000-gallon capacity gasoline USTs. The USTs have
not been in operation since 2009 and have been out of compliance with NC UST regulations for
temporary UST closure since that time. A notice of violation (NOV) was issued post-purchase
from the North Carolina Department of Environmental Quality (NCDEQ) to the owner of record
Mr. Guerra, although he was not the owner of record at the time of the documented noncompliance.
Mr. Guerra did not operate the USTs and was under the impression that the former
owner was responsible for the USTs when he purchased the property. Based on NC statutes,
Mr. Guerra, as the property owner when the NOV was issued retains full liability. Discussions
with NCDEQ personnel indicate that the only alternative to achieve compliance is removal of the
three USTs and associated appurtenances. Additional correspondence with NCDEQ dated July
2, 2019, indicates that enforcement action against Mr. Guerra was being considered if the USTs
were not removed within 60 days. Without the support of the City's Brownfield Assessment
Grant, Mr. Guerra would likely have to close his business.
